Welcome to the Avtosh online store. These Terms & Conditions govern the use of this website and all purchases made from Avtosh-Dream, trading under the Avtosh brand. By accessing our website or placing an order, you agree to these Terms & Conditions.

2. Definitions

In these Terms & Conditions:

Avtosh-Dream refers to the business operating this website.

Avtosh refers to the commercial trading name and brand of Avtosh-Dream.

Customer means any individual or legal entity purchasing products through this website.

Consumer means a natural person acting for purposes outside their trade, business or profession.

Products means all new, used, OEM, aftermarket parts, accessories and related automotive products offered for sale.

3. Applicability

These Terms & Conditions apply to every quotation, order and agreement concluded through the Avtosh website.

Any deviation from these Terms & Conditions shall only be valid if agreed in writing by Avtosh-Dream.

If any provision of these Terms & Conditions is declared invalid or unenforceable, the remaining provisions shall remain fully effective.

4. Products

Avtosh offers new, used, OEM and aftermarket automotive parts and accessories.

Many products are unique or available in limited quantities.

Used products have been inspected before shipment but may display characteristics consistent with previous use, including:

  • cosmetic wear
  • previous installation marks
  • storage marks
  • signs of age

These characteristics are considered normal and shall not in themselves be regarded as defects.

Product photographs form an essential part of the product description. Customers are encouraged to review all available images before purchasing.

Colours may appear slightly different depending on screen or device settings.

5. Product Compatibility

Customers are responsible for checking product compatibility with their vehicle based on the information available in the product listing.

Vehicle specifications may vary depending on model year, engine type, production date, trim level and market.

If compatibility is uncertain, customers are encouraged to contact Avtosh-Dream before placing an order.

Whenever reasonably possible, Avtosh-Dream will assist in confirming compatibility based on the vehicle information provided by the customer.

Avtosh-Dream cannot be held responsible for an incorrect compatibility assessment where it results from inaccurate or incomplete vehicle information supplied by the customer.

This section does not affect any statutory consumer rights, including the right of withdrawal where applicable, or Avtosh-Dream’s responsibility for incorrect product information supplied by Avtosh-Dream.

6. Prices

All prices are displayed in Euro (€).

Prices include VAT where applicable unless stated otherwise.

Shipping costs are calculated separately during checkout.

Although every effort is made to ensure accurate pricing and product information, Avtosh-Dream reserves the right to correct obvious pricing errors, typographical mistakes or technical inaccuracies.

Should such an error affect an order already placed, the customer will be informed before the order is processed.

7. Orders

Orders are processed after successful payment confirmation.

Products remain available while stocks last.

Where permitted by applicable law, Avtosh-Dream may refuse or cancel an order where there is a legitimate reason, including:

  • an obvious pricing error;
  • a technical website error;
  • suspected fraud;
  • payment failure;
  • product unavailability; or
  • circumstances that make fulfilment of the order reasonably impossible.

Where payment has already been received for an order that is cancelled, the amount paid will be refunded using the original payment method.

8. Payment

Payments are securely processed through Mollie using the payment methods offered during checkout.

Avtosh-Dream does not receive or store complete payment card information.

Orders are processed only after payment has been successfully confirmed.

9. Retention of Ownership

Ownership of supplied products transfers to the customer only after full payment has been received, where permitted by applicable law.

10. Shipping

Avtosh-Dream ships within the Netherlands and internationally.

Shipping within the Netherlands and the EU is available through the checkout where applicable.

Shipping to destinations outside the EU is available on request and may require separate confirmation of shipping availability and costs.

Estimated delivery times depend on the destination, carrier and shipping method.

Unless a different delivery period has been agreed, goods will be delivered within the period required by applicable consumer law.

Where Avtosh-Dream arranges the carrier, the risk of loss or damage during transport remains with Avtosh-Dream until the goods have been received by the customer, as required by applicable law.

Customers outside the EU are responsible for applicable import duties, customs charges and local taxes imposed by the destination country.

11. Right of Withdrawal & Returns

Consumers who are entitled to a statutory right of withdrawal under applicable law may withdraw from a distance purchase within 14 days after receiving the goods, without providing a reason.

The consumer may exercise this right through the “Withdraw from contract” function available on our website, by using the model withdrawal form, or by making another clear statement informing Avtosh-Dream of the decision to withdraw.

After communicating the withdrawal, the goods must be returned without undue delay and no later than 14 days after the withdrawal was communicated.

Consumers may inspect and test a product only to the extent reasonably necessary to establish its nature, characteristics and functioning.

If a product has been installed, used, modified, damaged or otherwise handled beyond what is reasonably necessary for such assessment, the consumer may be liable for the resulting diminished value. Any deduction will be based on the actual reduction in value of the returned product.

The statutory right of withdrawal does not apply where an exception provided by applicable law applies, including goods made to the consumer’s specifications or clearly personalised.

Return shipping costs are borne by the customer unless applicable law requires otherwise.

In case of withdrawal from the complete order, the standard original delivery costs will be refunded where required by law. Additional delivery costs resulting from a more expensive shipping method chosen by the customer are not refundable.

Avtosh-Dream may withhold the refund until the returned goods have been received or until the consumer provides evidence that the goods have been returned, whichever occurs first.

12. Warranty

All products sold to consumers are subject to the statutory consumer rights applicable under Dutch and EU law.

Where applicable, new products may also be covered by an additional manufacturer’s warranty. Such manufacturer’s warranty is additional to and does not replace the customer’s statutory rights against Avtosh-Dream as the seller.

Used products are sold as inspected used automotive parts. Unless otherwise stated, no additional commercial warranty is provided on used products.

This does not affect any statutory consumer rights, including the legal guarantee of conformity.

13. Installation

Many automotive parts require specialist knowledge and correct installation procedures.

Professional installation is strongly recommended.

Avtosh-Dream is not responsible, to the extent permitted by law, for damage or defects caused by:

  • incorrect installation;
  • improper or abnormal use;
  • racing, competition or off-road use where the product was not intended for such use;
  • unauthorised or unsuitable modifications;
  • improper maintenance; or
  • failure to follow applicable manufacturer instructions.

The fact that a product was installed does not by itself exclude statutory warranty rights.

Nothing in this section limits any mandatory consumer rights where the reported defect was not caused by the circumstances listed above.

14. Limitation of Liability

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

For consumers, the liability of Avtosh-Dream is governed by applicable mandatory consumer protection and liability law.

Avtosh-Dream is not responsible for loss or damage caused by improper installation, misuse, unauthorised modification or other circumstances attributable to the customer.

For business customers, and to the maximum extent permitted by law, Avtosh-Dream shall not be liable for indirect or consequential losses, and its contractual liability shall in principle be limited to the purchase price of the product concerned.

No limitation in these Terms & Conditions applies in cases where liability cannot legally be excluded or limited.

15. Intellectual Property

All content published on this website, including but not limited to:

  • product photography;
  • original product descriptions;
  • logos;
  • graphics;
  • branding;
  • website design;
  • text;

Remains the intellectual property of Avtosh-Dream unless otherwise stated.

No content may be copied, reproduced, distributed or commercially used without prior written permission.

16. Privacy

Personal data is processed in accordance with the Privacy Policy and applicable privacy legislation, including the General Data Protection Regulation (GDPR), where applicable.

Customer information is processed solely for purposes including:

  • order fulfilment;
  • shipping;
  • customer support;
  • legal compliance;
  • fraud prevention.

17. Force Majeure

Avtosh-Dream shall not be liable for any delay or failure to fulfil its obligations where such delay or failure results from circumstances beyond its reasonable control.

These include, but are not limited to:

  • natural disasters;
  • fire;
  • flooding;
  • war;
  • pandemics;
  • government restrictions;
  • cyberattacks;
  • power failures;
  • transportation disruptions;
  • labour disputes.

During such circumstances, contractual obligations may be suspended for the duration of the event.

Nothing in this section affects any mandatory consumer right to terminate an agreement or receive a refund where such right arises under applicable law.

18. Governing Law

These Terms & Conditions are governed by the laws of the Netherlands.

This choice of law does not deprive consumers of any mandatory consumer protection rights applicable under the laws of their country of residence.

Any dispute shall be submitted to the court having jurisdiction under applicable law.
